When many of these people escape from these countries, there aren't as many resources for them as there are for other undocumented and asylum seekers. America's asylum law unfortunately doesn't explicitly recognize sexual orientation as a basis for refugee status like race and religion. Gay and teams folk have to plead their case under the general rubric of belonging to a particular social group (PSG), which can be hit or miss case law. Also country conditions have sway in immigration proceedings. Hopefully, the immigrants rights groups start pushing for action on siuations like these searches to the same degree that they do for female genital mutilation in African and Arab countries.

It also depends on the Circuit you live in, as immigration cases are essentially administrative law hearings unless they are appealed (going to US Appeals or rarely SCOTUS). The 9th Circuit pretty much considers most gay folk to be members of a PSG by virtue of being homosexual; I'm not sure about your circuit (6th), and mine is hit/miss (7th).

If we get a Clinton-Warren ticket (yay!), I'm sure there will be progress on the issue. But the laws that hinder LGBT claims would have to be changed by Congress (amending the REAL ID Act and the Illegal Immigration Reform and Immigrant Responsibility Act).

A doctor friend told me that in the 1950s, during the red scare and the lavender scare, public health doctors attached to the immigration service tested suspected foreign homosexuals trying to enter the US by an anal exam and also be testing their gag reflex. A loose anus = homosexual; no gag reflex = homosexual. I have not researched this to see if it is true, but it does pass Colbert's truthiness test.

 

I'd like to say I'm surprised by this but that would be a lie. African countries are some of the most regressive and barbaric when it comes to issues around sexual orientation. The middle-east is probably the only region that tops them in this regard(no pun intended).
