Christian Mingle Must Now Allow Same-Sex Matches Following Discrimination Lawsuit

    Dating site ChristianMingle.com will soon allow users to search for same-sex matches, courtesy of a "judge-approved settlement of discrimination claims," the Wall Street Journal reported on Thursday.

    Under the terms of the settlement, the outcome of a lawsuit filed in California against dating site operator Spark Networks Inc. in 2013 by two gay men who claimed the company's refusal to provide same-sex matches constituted discrimination, Christian Mingle and other sites operating under the company's purview will simply ask whether users are men or women. The settlement also requires the company to introduce features to Christian Mingle making it easier for gay and lesbian users to find others on the site.

    Other sites covered by the settlement include CatholicMingle.com, AdventistSinglesConnection.com and BlackSingles.com, the Journal added. According to a version of the settlement posted to the Journal's web site, Spark will pay out $9,000 to each of the plaintiffs and $450,000 in legal fees to the firm representing them.

    The settlement appears to have struck a nerve in the right-wing media, with BizPac Review deeming the change a "terrible blow — yet another attack on liberty," and Red State opining the courts had been "Attacked By LGBT Activists And Suffers The Consequences."

    On Friday, Christian Mingle's Facebook page posted an article with the headline "Why a Test of Faith is Something to Be Thankful For," accompanied by the caption "Trials are never fun, but it's helpful to know that God is working through them."

    However, lawyer for the plaintiffs Vineet Dubey argued the exclusion of same-sex matches was a clear violation of California's anti-discrimination laws.

    "I am gratified that we were able to work with Spark to help ensure that people can fully participate in all the diverse market places that make our country so special, regardless of their sexual orientation," Dubey told the paper.

    If Christian mingle was affiliated with and run by a religious organization, that would be different. But it's a business, so they are subject to the same laws as other businesses.

    Thats true, but I don't know why someone would want to use a service that was mandated by court order, not developed without malice to meet an audience need. It reminds me of those white gay couples that DEMAND some Christian baker acknowledge them by making their wedding cake. Do you really want to eat something made by an antagonist?

    I see an entrepreneurial opportunity for actual gay singles that are Church-based to create their own service. It would probably be more inviting and feel more natural as the audience would have shared cultural and religious values and understanding.

    If a devout gay Christian wants to meet a devout gay Christian, now there is a forum to do so. That's the point, besides just suing because the practice of discrimination is wrong. No one wants to patronize assholes at the end of the day, but they do want to punish them. That's why u sue.

    Understood. Not trying to give them a pass. I'm just looking at it from a support-your-own standpoint; i.e. I'd rather buy a chicken sandwich from a restaurant that acknowledged me as a black/LGBT human being than Chik-Fil-A...or make my own sandwich. I'm more of a libertarian on these kind of lawsuits, as unlike government services or taxation, I have a hard time seeing the need for a ruling on the service as it doesn't have a monopoly from an antitrust standpoint; that is, it is a service for which there is no barrier to entry for new market actors (a competitive service for a distinct market such as Gay Christians can set up its own site and solicit customers); and no collusion among actors (e.g. this service and eHarmony trying to prevent a new competitor entering the gay Christian dating service market).

    I'll have to find the actual decision, as I'd like to see the legal rational, statute or case law for the action plus I learned a long time ago not to trust how journalists interpret case law and legal decisions unless they are actually attorneys, like Harvey Levin. I find it curious, according to the article, that their Jewish dating component was left out, but all other components including the Black and Catholic ones were subject to the ruling. California's Unruh Civil Rights Act covers all businesses in that state, so it makes sense for ChristianMingles to just change code rather than try to fight it, lose, and start doling out treble damages.

    That being said, I'm glad the service is available for those that want it.

    Laws can't be written strictly from an economic perspective, although you can likely attach an economic implication to most. They exist for societies to establish order on economic, social, moral and other issues. Most folks won't disagree with you. Supporting your own is fine--if you had your own to support or the means to create your own. But this suit is more punitive than anything. They broke a social law and the ruling was not to enrich the plaintiff, more than it was to punish the defendant and ensure that future business practices are compliant with all economic, social and moral laws.

    Agreed. Most of my response was intellectual shit shooting and working out my morning hangover. Lol. Like I said, I'm all for anything that helps folks to get together. People should have positive outlets to meet like minded folk and church attending LGBT shouldn't feel like finding someone is a Grindr-or-nothing proposition.

    In all fairness, my latest FWB is a church bro, and we meet on common ground. We both see the truth in this commercial and most churches think like this (not endorsing this particular group)
